George Osborne will tomorrow vow to stick by his controversial plan to wipe out Britain's £109bn structural deficit in one parliament, saying the alternative of delay would only hit the poor and consign the country to a decade of debt.
 

 

In his speech to the Conservative party conference in Birmingham, the chancellor will announce that every Whitehall department will have its head office staff cut by a third, promise to give the armed forces the tools to finish the job, and dismiss Britain's public service structure as designed for the 1950s.
 

 

He will audaciously offer the deficit reduction plan as an example of his One Nation Conservatism, rather than an ideological assault on the state, and will hold out the prospect of lifting more people out of tax through raising thresholds.
 

He will insist that "there will be no cuts for its own sake, but instead savings to secure our future".
 

However, Osborne will warn that Labour's prescription of a slower deficit reduction would mean extra interest payments to foreign governments in addition to the £120m currently being paid each day. "Delay now means pay more later. Everyone knows it's the most basic rule of debt. So Labour's cuts would not be smaller – they would be bigger and last longer," he will say, leading to "a decade lost to debt".
 

His speech two weeks before the spending review betrays coalition nerves that the public supports deficit reduction in principle, but will recoil from the speed, scale and specifics of the government's plan.
 

In a conference certain to be dominated by the coming spending cuts, both David Cameron and the work and pensions secretary, Iain Duncan Smith, strongly hinted that some universal benefits will have to be cut in part to implement a 10-year total overhaul of the welfare system, ending with the merger of tax credits and a range of work-related benefits.
 

Duncan Smith said the payment of benefits to people earning more than £50,000 a year was "completely bonkers", remarks that suggest the government is willing to tax child benefit, or restrict other universal benefits such as the winter fuel allowance.
 

The withdrawal of some universal benefits from middle-class families has won the surprise support of Martin Narey, chief executive of Barnardo's. Writing in the Guardian, he says the case for reform is now morally overwhelming.
 

The coalition's proposed universal credit will be phased and initially focused on those on jobseekers' allowance and on incapacity benefit, with a guarantee that anyone transferring to the new credit will not lose money. The scheme, designed to remove disincentives to work, will have an upfront cost.
 

Cameron confirmed that a deal had been struck between Osborne and Duncan Smith on a "refreshingly radical" plan for welfare reform, but the decade-long timescale gives the Treasury time to see whether the scheme is workable.
 

In his speech Osborne will also seek to counter Labour leader Ed Miliband's accusation that the coalition has a pessimistic vision of Britain's future and is using the deficit as a cover for cuts. He will insist his aim is to build "a hopeful, united and prosperous country". "You don't get to chose the times you live in," he will say. "But you do get to choose how you live in them. And just over the horizon lies the Britain we are trying to build."
 

His priority in the spending review will be to support growth through investment in transport schemes, medical research and communication networks. In an interview with the Guardian tomorrow the transport secretary, Philip Hammond, reveals an extra £800m of public money will be pumped into Britain's high-speed rail network.
 

Osborne will also list a string of announcements in the spending review that will please Liberal Democrat colleagues in the coalition, including public funding for green investment, and carbon capture and storage "so we reap the financial rewards of the green energy revolution".
 

He will also promise to press ahead with a pupil premium so "the poorest in our country have access to the kind of education only available to the best".
 

He will defend the public service reforms, saying: "We saw over the last 10 years that more money without reform was a recipe for failure. Less money without reform would be a recipe for disaster." He said changing the way services such as education, health and the police work "is no longer a luxury; it has become a necessity."
 

In the other crucial conflict in the spending round – defence – supporters of the defence secretary, Liam Fox, were claiming he was making progress in resisting some of the Treasury's demands on his budget.
 

Cameron promised not to take "risks" with Britain's defences, insisting he was pro-defence. Fox last week wrote privately to the PM warning that "draconian" reductions being demanded by the Treasury in his department would have "grave consequences" for the armed forces.

英國製造業PMI創10個月新低 新出口訂單下滑

金融資訊服務機構Markit Economics、特許採購與供應學會(Chartered Institute of Purchasing and Supply;CIPS)1日公佈,經過季節性因素修正後,英國9月製造業採購經理人指數(PMI)終值為53.4(初值54.3),低於前月的53.7且創下10個月以來新低,惟連續第14個月高於景氣榮枯分界點(50)。

外電報導,經濟學家一般預估PMI將升至53.8。  

在組成PMI的五個分項指數當中,新訂單僅微幅上揚,遠低於15個月平均值,其中新出口訂單出現2009年7月以來首度下滑的狀況。  根據嘉實XQ全球贏家系統資料,紐約匯市1日尾盤時,英鎊兌歐元貶值0.26%,報1.1489,創4月20日以來新低;盤中一度貶至1.1482。

IMF主席卡恩︰全球匯率戰可能性提升

〔編譯盧永山/綜合報導〕國際貨幣基金(IMF)主席史特勞斯卡恩呼籲主要經濟體合作,不要藉著貶值貨幣來提振出口,因而爆發全球匯率戰爭,妨礙世界經濟復甦。
史特勞斯卡恩在黑海的雅爾達參與經濟會議指出,全球經濟正在復甦,但非常不平均。他說,主要經濟體不願像二○○八年全球經濟危機爆發時,共同合作執行克服危機的措施,已成為全球復甦的最大危機。
中國等若干經濟體為了提振出口,一直壓低匯率,而屢遭貿易夥伴批評,巴西財長蒙帝嘉日前表示,全球正在醞釀匯率戰爭。
中國人民銀行今年六月十七日宣布增強人民幣匯率彈性後,迄今人民幣兌美元僅升值約二%,引起美國政府和國會議員不滿。
史特勞斯卡恩表示:「我們因在經濟上展開合作,尤其是貨幣政策和財政刺激方面,最後成功避免更大的危機,如今我們面臨另一個威脅,那就是彼此的共識和合作意願減低, 全球爆發匯率戰爭的可能性升高。」
史特勞斯卡恩指出,各國經濟決策人士重新展開合作,討論貨幣的幣值,設法調整已經調整的做法,對抗全球失衡,若不那麼做,各國難用國內方式解決全球問題,因此將形成新危機。
最近幾週,哥倫比亞、新加坡等十幾個國家都坦承,已大舉買進美元,來壓低本幣匯率,以提振出口。
此外,針對英國金融時報報導,過去一年法國與中國一直進行秘密談判,討論匯率合作事宜,法國政府官員已予否認。
這名官員表示,法國總統薩科茲今年十一月將擔任二十國集團(G20)高峰會輪值主席,目前正在為此作準備。
薩科茲今年八月重申應檢討全球貨幣體系,強調有關貨幣的討論,應開放給七大工業國以外的國家討論,包括中國,呼籲加強國際合作和全球治理。

媒体称基地正策划袭击英法德等国主要城市

美國國務院3日向在歐洲國家旅遊的美國遊客發出警告,防範可能發生的恐怖襲擊危險。
歐洲多家媒體2日報導,有情報顯示,基地組織正在策劃對歐洲英、法、德等國的多座主要城市實施恐怖襲擊。

英國廣播公司(BBC)和天空電視臺2日報導,多家西方情報機構近期獲得情報顯示,基地組織正策劃針對英國、法國和德國的恐怖襲擊。
3日出版的德國《明鏡》週刊則報導說,這場襲擊由基地組織三號頭目謝赫·尤尼斯·馬里塔尼策劃。
情報機構獲知這一消息的管道是通過一名在阿富汗被捕的德國公民艾哈邁德·西迪基。《明鏡》週刊說,馬里塔尼與西迪基有聯繫,告訴了他這一陰謀,而西迪基最近在阿富汗落網,眼下正監押在美軍控制的巴格拉姆空軍基地。
文章說,西方情報機構從西迪基口中得知這一陰謀,德國情報人員正準備前往喀布爾對西迪基展開進一步問訊。
現年36歲的西迪基今年7月在喀布爾落網,而此前不久,他剛剛在巴基斯坦北部米爾阿裏地區與馬里塔尼會面。
西迪基出生於德國漢堡,據稱與“9·11”恐怖襲擊事件中的劫機者之一阿塔相識。

馬沙說,這樁陰謀仍處於策劃階段。現階段尚不清楚恐怖分子是否已經人在歐洲。但是,英國、德國、法國和美國之間的情報共用已經打亂了這一陰謀
馬沙說,一些情報顯示,恐怖分子原先計畫在歐洲城市實施類似孟買襲擊那樣的行動。2008年,印度金融中心孟買發生連環恐怖襲擊,多名武裝人員手持自動武器,襲擊火車站等重要目標,173人死亡,數百人受傷。

美國務院說,根據當前掌握的資訊,基地組織及其分支機搆仍在計畫發動恐怖襲擊。歐洲國家政府已經採取行動防範可能的恐怖襲擊危險。恐怖分子可能利用多種手段發動襲擊,政府和私人目標都可能成為襲擊物件。
美國務院提醒在歐洲旅遊的美國遊客警惕可能發生的針對公共交通系統和其他旅遊設施的恐怖襲擊,採取適當安全措施保證旅途安全。

對歐洲經濟影響深遠
美國務院表示將繼續與歐洲各國就打擊包括基地組織在內的國際恐怖主義密切合作,共用相關資訊以挫敗恐怖圖謀,加強對潛在威脅的防禦能力。
美聯社認為,這樣一份旅行警告對歐洲經濟的影響將極其深遠,因為在歐洲旅行、求學、經商的美國公民相當多,數以十萬計。一旦旅行警告發佈,不僅影響前往歐洲的美國人,還會潛在影響前往歐洲的其他外國人。
美國國務院警告級別包括低威脅水準建議、正式旅行警告,再到嚴重警報,依據威脅水準不同而分級。

給法律人的一封信 蔡英文

各位有志學習法律的人們:

現在的法律系是熱門的科系,你們都是聰明優秀的年輕人,想必帶著
父母親的高度期望和滿腔的抱負憧憬成為法律人,大家看到了總統、副總
統、前行政院長、台北市長、高雄市長、台灣省主席都是出身自台大法律
系,也經常看到收入優渥的大律師們在社會公共事務上的活躍身影,總希
望自己有一天在社會上能有那樣耀眼的表現。

無法理解抽象而不知所云的法律文字

我有一點和你們不一樣,我只是因為經商的父親希望我唸法律,放棄
了感到興趣的中文系,進入了當年不熱門的法律系。但幸運的是,被認為
是一個不會唸書的小孩,哥哥姊姊都很會唸書,父母親對我沒再有什麼特
別期待,因此,我的學習過程完全沒有來自家裡的任何壓力,可以按自己
的方法做自己想做的事情。

可是,我的大學生活卻仍然非常痛苦,因為實在無法理解那些硬繃繃
、抽象而不知所云的法律文字,除了比較貼近日常生活的一些買賣、借貸
、租賃,或是小過小錯之外,你想,票據、公司,甚至海商,那距離大學
生的生活經驗有多麼遙遠啊!法律是生活經驗的東西,要年輕識淺的大學
生來唸,真是一件很困難的事情。我大二上蔡墩銘老師的《刑法總則》就
被當得很慘,大一上洪遜欣老師的《民法總則》,當他以日式台灣國語講
解他畢生精研的法規時,是對一個不足20歲的學生嚴酷的考驗。我的成績
並不理想,這讓我一度感到自卑,但還是跟著大家畢業,就這麼把大學唸
完了。

那時覺得呂光老師的英美法的案例教學是很好的,讓我們能夠真正掌
握法律和生活經驗之間的關係,我很喜歡看這些真實的法律故事;此外,
對經濟學也有一些興趣。由於總覺得大學四年還沒有把書唸完,就安排出
國留學。

我原本嚮往英國倫敦政經學院的學風,但美國的學制我們比較容易適
應,在姊姊建議下我先到美國讀碩士。由於美國的法學院都是大學畢業以
後才能唸的,所以學生一般都比較熟悉人情世故,其他專業的背景也讓他
們對於法律的適用比較有方向感,到了那裡,接觸了各式各樣的人,從他
們的經驗中知道了人生百態,我才對法律 的學習有了較多的體會。

希望接觸新奇而有挑戰性的社會事務

到了英國以後,由於他們的博士班並沒有像我們一樣的選修或必修課
程,修課的內容全由博士生本人按照自己的需要來規劃設計,指導教授只
是從旁帶領,所以,我常會自己坐下來想,要怎麼走。我記得我在修有關
國際貨幣基金會的課時,我們花了一大半的時間在討論國際金融與經濟的
運作原理,我發現我以前廣泛的社會學科學習興趣,使我很容易地進入國
際經濟法的堂奧,在這裡,法律的規定成為很次要、技術性的東西,我博
士論文研究的是國際競爭法,那種法律萬能主義的觀念,完全不合時宜,
我在這裡真正找到法律的靈魂,不再被過去學習經驗所左右。此外,聽過
當時英國法律先進的一句話:「什麼是法律人?就是你講的話別人聽不懂
。」這給我很大的警惕,因為我原本就是那種聽不懂法律人說話的學生,
我很同意,法律人應該要學會和別人相處,知道怎樣把專業的法律說到別
人都聽得懂,那才是最困難與最重要的。

拿到博士學位之後,我一開始很想把博士論文燒掉,然後從此不再看
法律的書,因為我已經受夠了。我四處去旅行,還想到新加坡大學去教書
,不知過了多久,我父親終於在世界的某個角落找到我,他電話叫我回台
灣,這是我的家,我就這樣回家了,成為大學教授。

記得有一天,我在台大校本部看見一位老教授一手提著公事包迎面而
來,老教授的身影是值得尊敬的,可是有感而發地問自己:「難道我要像
他這樣一輩子只在一個特定的領域中鑽研理論嗎?」,我希望每天接觸各
種新奇而富有挑戰性的社會事物,這不也是一條挺有趣的人生選擇嗎,為
了拓展不同的視野,我接受政府的邀請,在1980年代中期輾轉投入國際貿
易談判事務,從現場的翻譯做起,開始參與政府的工作;也曾經接受美國
律師的訓練。至今仍對於口譯或書寫的翻譯人才懷著敬意,因為我知道,
他們不是翻譯機,如果沒有熟練的兩種語言能力和豐富的相關知識,怎麼
把那些專業的概念,說到別人都聽得懂?

如果再給我一次機會,還是會選擇法律

如果再給我一次機會,我還是會選擇法律。在台大法律系學到最深刻
的還是法學訓練的邏輯思考。每一種學科當然都有體系的建構和邏輯的思
考,可是,法律學更能鮮明地展現這種注重邏輯的性格,尤其,法律訓練
把人的行為拆解成各種構成要件的組合,讓法律人在做事理的判斷和分析
時,很容易建立條理和架構,得以應付各種複雜的事務,是任何一種學科
都無可比的。

現在的法律系學生都非常頂尖,家長的期許也都很高。因為我從小就
被認為是學習較緩慢的小孩,而沒有成長壓力,因此體會很深,建議家長
不要給聰明的小孩過高的成就期待,讓他有發展的空間。

我們以前律師名額少,參加考試就像古代的科舉,是人生的豪賭。現
在既然放寬了許多,法律人更應該好好規劃自己的生涯,努力充實自我,
不要太早急切於功成名就,成功的法律人應該要有豐富的人生閱歷,我認
為要到了40歲左右才比較成熟,最好趁年輕時爭取各種學習的經驗,慢慢
明確自己適合發展的方向,若太早就限制在傳統的軌道上,不能把優秀的
聰明才智做出更有貢獻的開展,是我們國家社會的損失,也是個人成就上
的損失。

法律是人生及社會經驗的累積

其次,我要勸告法律人不要驕傲,切勿自滿。驕傲和自滿會讓你忘了
追求進步。要心胸開闊,有機會趕快爭取。還有,人們對於越聰明的人期
待越高,容忍度往往就越小,反而形成壓力的來源,建議法律人學會不引
人側目,這樣才會為自己留下成長的空間。

第三,進法律系的目標應是接受與追求邏輯思考的法學訓練,不要只
是為了考上法官,取得律師資格;我也不贊成以國家考試的錄取率來衡量
法律系所的辦學成績,法律不是目的或唯一的選擇,人生不會只到大學畢
業就終止了,若能善用法律的思維鍛鍊,在適當的地方,就會發芽茁壯,
不論日後從事什麼行業,做什麼事,都會發揮奧妙功用。重要的是,法律
是一種人生及社會經驗的累積,在學習法律之餘,應該要用心體會人生,
細心觀察社會的現象及脈動。

第四,法律是一個嚴謹,甚至於是講究具體證據及細節的學科,這固
然可以養成法律人嚴謹的個性;但有時也限制了法律人宏觀的思考及心胸
的開拓,而流於斤斤計較的法律匠,法律人要引以為戒。

年輕人,希望你在40歲時也會說「如果再給我一次機會,我還是會選
擇法律」,時間站在你們這一邊,請多珍惜。

英國首相卡梅倫:財政計劃已令英國擺脫危險境地

英國首相卡梅倫稱,政府的財政計劃已經令英國擺脫“危險境地”,但承認經濟未來將面臨“動蕩時期”,同時對有關英國經濟可能面臨二次衰退的言論不予理會,稱政府將堅持其財政緊縮計劃。  綜合媒體10月3日報導,英國首相卡梅倫(David Cameron)3日表示,政府的財政計劃已經令英國擺脫“危險境地”,但承認經濟未來將面臨“動蕩時期”。  

在保守黨年度會議開放日接受英國廣播公司(British Broadcasting Corp,簡稱:BBC)采訪時,卡梅倫也確認了福利支出大幅改革的規模,他稱此改革將隨著時間的推移節省“大量資金”。  經濟方面,卡梅倫對有關英國經濟可能面臨二次衰退的言論不予理會,稱政府將堅持其財政緊縮計劃。  他表示,英國財政大臣奧斯本(George Osborne)6月頒布的緊急預算案已經幫助降低英國貸款利率,并緩解了債券市場壓力。  

他還稱,“英國曾與葡萄牙、希臘和西班牙等面臨評級下調的國家在利率上升方面具有相似性,但我們現在已經使英國擺脫危險境地,我國利率事實上已經下降”。  卡梅倫表示,政府的財政計劃允許英國央行(Bank of England,簡稱:BOE)維持“相對擴張的”貨幣政策。英國政府的財政計劃旨在未來5年內財政緊縮1,130億英鎊。

 David Cameron this morning confirmed that the coalition plans to scrap many existing welfare benefits and replace them with a single benefit. The prime minister told the BBC's Andrew Marr Show that, although the reform would cost money upfront, it would save public funds in the long run.
The Tory leader, whose party conference begins today in Birmingham, described the reforms as an example of his "bold and radical" government. "What we are putting forward is the most radical reform of the welfare state for 60 years ... It will have a transformative effect for people in work and people on benefits."

Cameron said: "We spend billions of pounds on welfare, yet millions are trapped on welfare. It's not worth their while going into work."

He said the reform was a "big, bold change. It does cost some money upfront," and some cuts to the welfare bill to pay for it would be announced in the 20 October spending review, but in time the reform would make great savings for the Treasury. "Over time it has the capacity to save huge amounts of money, because it will end a lot of the fraud, a lot of the error, a lot of the waste, and because it is always worth people going into work."

Under the new plans, "if you can work and if you're offered a job and you don't take it, you cannot continue to claim benefits. It will be extremely tough," he said.

Would it be in place by this time next year? "I believe that is the case, but this is going to take a long time to bring this whole change in, because you are migrating people off a whole range of benefits and tax credits ... on to one single universal credit system."
He denied there would be substantial numbers of losers from the reform.

The shape and cost of the new welfare reforms had been the subject of dispute between George Osborne, the chancellor, and Iain Duncan Smith, the work and pensions secretary, but Duncan Smith appears to have got his way.

Cameron also gave a strong hint that universal benefits such as child benefit could become means-tested under coalition plans. Such spending was no longer "affordable", the prime minister said. "On the one hand we have got to ask, are there some areas of universal benefits that are no longer affordable? But on the other hand let us look at the issue of dependency where we have trapped people in poverty through the extent of welfare that they have."

He went on: "I think it is very important that there are universal benefits. We pay into this system, that is why I want a really good state pension system. We are the first government in a long time to link the pension back to earnings."

Asked if he was against means-testing on principle, Cameron said: "What we basically need is a system that has universal and fair elements that are part of a decent and civilised society, like a good strong pension provision, and then in terms of the work-related benefits you need a system that means you are always better off in work and working hard."

It has been estimated that setting the limit for receipt of child benefit at age 16 rather than 19 would save £2bn a year, and means-testing could produce more savings. But means-testing is criticised for introducing complexity into the system and threatening takeup for lower earners.
Yvette Cooper, the shadow work and pensions secretary, said: "The government is clearly planning a massive assault on families. Cutting child benefit for 16-year-olds will hit hard-working parents who badly want their children to stay on at school. This is an attack on aspiration and on overstretched families who want their teenagers to do well.

"The government is already cutting £3bn from tax credits and support for children. Introducing means-testing for child benefit as well would put many low- and middle-income families off claiming the support they badly need."

Asked about the row over planned defence cuts sparked by the leak of a letter from Liam Fox, the defence secretary, Cameron said: "All these things are ongoing discussions we've got to get right. These are huge decisions but what you've got to do is look at the threats we face today ... We need, in many cases, to make our armed forces more flexible, more adaptable." He said the UK currently had tanks and planes built to fight the USSR. "That's not what you need today ... Of all the things I've inherited as prime minister, this is the biggest mess."

Asked if the government would take a decision on the renewal of the Trident nuclear deterrent within this parliament, or delay it as some Lib Dems want, Cameron said: "There'll be a stream of decisions, some before, some after."

Asked about the new Labour leader, Ed Miliband, the prime minister told the programme: "The big test for him is the deficit. This is the big issue of British politics. They [Labour] don't seem to have an answer at all."

Earlier he had said of the deficit and the budget cuts proposed to deal with it: "Britain's budget deficit is something we can't get away from dealing with. It's like a family's credit card because it gets bigger the more you leave it." He said that when the coalition took power the UK was "being linked with Greece and Portugal", and action had to be taken.
Cameron was also asked about the comments by the justice secretary, Kenneth Clarke, suggesting the UK might fall back into recession. He said: "I look at the forecasts, the forecasts from the Office for Budget Responsibility, the CBI and others, they forecast growth. But yes, it will be a choppy period that we'll go through."

Would that mean the coalition's planned cuts might be amended if the economy went into a double-dip recession? "I don't believe in positing all these conditional questions about the future," said Cameron.
